Swepco case resumes
The fate of Swepco's proposed power plant in Fulton (Hempstead Co.) is back on the table as the hearing resumes before the Arkansas Public Service Commission. The hearing could last at least a week. Pursuant to the Arkansas Utility Facility Environmental and Economic Protection Act (codified at Ark. Code Ann. § 23-18-501 et seq; see also Act 475 of 2007), the ultimate question for the PSC is to determine the nature of this facility's "probable environmental impact" and whether adverse environmental impacts are "acceptable" considering several factors.
