Online pharmacies and Act 128 of 2007
The Arkansas Democrat-Gazette has piece this morning on online pharmacies' compliance with new Arkansas law that prohibits pharmacists from filling a prescription when they know a doctor wrote it based solely on an Internet questionnaire or consultation. Act 128 of 2007 was enacted at the request of the Arkansas Pharmacy Board, since they have no authority over Internet brokers or pharmacies not licensed here.
An emergency clause was attached to the Act (adopted after two tries in the Senate), meaning that it went into effect on February 21, 2007, the day it was signed into law by the governor. Still, companies like mypharmausa.com have continued to send unsolicited fliers into Arkansas offering prescriptions "without a prescription."
